Welcome to Centerville 3D & Aerial Photography LLC DBA Centerville Shutter & Co. (“Centerville Shutter,” “we,” “us,” or “our”). We provide professional photography and related media services throughout Washington State.

This page outlines the general policies governing your use of our website and our photography services. Individual projects may also be governed by a separate proposal, estimate, booking confirmation, service agreement, model release, property release, or other written agreement. If a signed agreement contains terms that differ from these general policies, the signed agreement will control for that specific project.

By using this website, submitting an inquiry, requesting services, booking a session, paying an invoice or retainer, or otherwise engaging Centerville Shutter & Co., you acknowledge that you have had an opportunity to review these policies.


1. Website Terms of Use

All content appearing on this website, including photographs, graphics, logos, text, designs, videos, written descriptions, and other original material, is owned by or licensed to Centerville Shutter & Co. unless otherwise stated.

You may view and use this website for personal or legitimate business purposes. You may not copy, reproduce, modify, distribute, sell, publish, scrape, download, or otherwise exploit website content without prior written permission.

Unauthorized use of our photographs or other copyrighted material may constitute copyright infringement.

Centerville Shutter & Co. reserves the right to update, modify, suspend, or discontinue portions of this website at any time.

We make reasonable efforts to keep website information accurate and current; however, pricing, availability, services, portfolio examples, and other information may change without notice.


2. Photography Services

Centerville Shutter & Co. provides photography and related media services that may include, but are not limited to:

  • Real estate photography
  • Architectural and commercial photography
  • Family and group portraits
  • Senior portraits
  • Wedding photography
  • Boudoir photography
  • Event photography
  • Drone/aerial photography
  • 3D/virtual tour services
  • Video and social media content
  • Construction and progress photography
  • Other photography or media services agreed upon in writing

The specific services, deliverables, pricing, turnaround time, usage rights, and other requirements for a particular project may be outlined in a separate agreement or invoice.


3. Booking & Reservations

A date or time is not considered permanently reserved until Centerville Shutter & Co. has confirmed the booking and any required retainer, deposit, or payment has been received.

For certain services, a signed agreement may also be required before the booking is considered confirmed.

Verbal conversations, text messages, social-media messages, or informal discussions do not modify a written service agreement unless the modification is subsequently confirmed in writing by Centerville Shutter & Co.


4. Pricing & Payments

Prices are based upon the services, deliverables, location, duration, equipment requirements, editing requirements, licensing, and other circumstances associated with a particular project.

Additional fees may apply for:

  • Travel outside the included service area
  • Mileage
  • Parking or tolls
  • Permit fees
  • Additional shooting time
  • Additional locations
  • Rush delivery
  • Additional editing
  • Additional images or deliverables
  • Additional licensing or commercial usage
  • Special equipment
  • Re-shoots requested because of circumstances outside the photographer's control


Unless otherwise stated in writing, invoices are due according to the payment terms shown on the applicable invoice or agreement.

Client payment obligations are not dependent upon whether the client has received payment from a third party, including a real estate brokerage, builder, contractor, employer, publication, or other customer.


5. Retainers, Deposits & Payments

When a retainer or deposit is required to reserve a date, that payment may be applied toward the contracted services as specified in the applicable agreement.

A retainer is intended to compensate Centerville Shutter & Co. for reserving the date and declining other work for that period.

Refundability of any retainer or deposit will be governed by the applicable service agreement and applicable law.

Nothing in this policy is intended to waive any cancellation or refund rights that cannot legally be waived.


6. Cancellation & Rescheduling

We understand that circumstances sometimes change.

Clients should contact Centerville Shutter & Co. as soon as possible if they need to cancel or reschedule.

Cancellation and rescheduling terms may vary depending upon the type of session and the amount of preparation, planning, travel, staffing, equipment, or other resources required.

If a client cancels a session, the client may be responsible for amounts specifically identified as non-refundable in the applicable agreement, to the extent permitted by law.

Centerville Shutter & Co. may offer a rescheduling option when reasonable and when our availability permits.

Failure to appear for a scheduled session without notice may be treated as a cancellation or no-show.

Nothing in this section limits any cancellation rights provided by applicable Washington or federal law.


7. Weather & Unforeseen Circumstances

Photography can be affected by weather, unsafe conditions, emergencies, venue restrictions, power outages, equipment failure, illness, transportation problems, governmental restrictions, natural disasters, or other circumstances beyond reasonable control.

For outdoor photography, Centerville Shutter & Co. may recommend postponing or rescheduling a session when weather or environmental conditions could compromise safety or the quality of the work.

We will make reasonable efforts to reschedule affected sessions.

For real estate photography, weather-related exterior limitations may not automatically require a complete reshoot. Where appropriate, Centerville Shutter & Co. may photograph available portions of the property and return later for exterior or aerial images when conditions permit.


8. Photographer Illness, Emergency or Unavailability

Although we make every reasonable effort to fulfill confirmed bookings, circumstances may arise that prevent Centerville Shutter & Co. from performing the services as scheduled.

If the photographer becomes unavailable because of illness, injury, emergency, equipment failure, or another substantial circumstance, we may:

  1. Reschedule the session;
  2. Provide a qualified replacement photographer when reasonably available and appropriate; or
  3. Provide an appropriate refund or other remedy as determined under the applicable agreement.

Our liability for failure to perform due to circumstances beyond our reasonable control is limited to the remedies provided in the applicable agreement and applicable law.


9. Image Selection & Artistic Judgment

Photography is an artistic service.

Centerville Shutter & Co. retains professional and artistic discretion regarding:

  • Composition
  • Lighting
  • Camera settings
  • Posing
  • Angles
  • Cropping
  • Color grading
  • Editing
  • Image selection
  • Retouching
  • Final delivered photographs

Not every photograph captured during a session will be delivered.

RAW files, unedited photographs, rejected photographs, test photographs, duplicates, and outtakes are generally not included unless specifically agreed to in writing.


10. Editing & Retouching

Standard editing may include exposure, color, contrast, cropping, perspective correction, white balance, basic blemish correction, and other adjustments appropriate to the service purchased.

Extensive retouching, object removal, compositing, body modification, restoration, or other specialized editing may be available for an additional fee.

Clients may request reasonable editing preferences before delivery when appropriate. However, Centerville Shutter & Co. retains final artistic discretion over the finished images.


11. Copyright Ownership

Unless otherwise agreed in a written contract, Centerville Shutter & Co. retains the copyright to photographs and other original creative works produced by the company.

Purchasing photography services does not automatically transfer copyright ownership to the client.

Clients receive the usage rights or license specifically granted by their applicable service agreement, invoice, package, or written permission.

Copyright ownership and usage rights are separate from possession of digital files.


12. Client Image Licensing

Unless otherwise specified in writing, a client receiving digital photographs receives a limited, non-exclusive license to use the delivered images for the purposes identified in the applicable agreement.

For example, depending upon the service purchased, permitted use may include:

  • Personal social media
  • Personal websites
  • Business websites
  • Marketing
  • Advertising
  • Print materials
  • MLS or real-estate marketing
  • Brokerage marketing
  • Builder or contractor marketing
  • Portfolio or promotional use

Images may not be sold, sublicensed, transferred, resold, altered, or provided to another party for commercial use beyond the granted license without written permission.

Commercial licensing requirements may differ depending upon the intended use.


13. Real Estate Photography

Real estate photography is generally provided to assist with marketing a property.

Unless otherwise agreed in writing, the client is responsible for ensuring that:

  • The property is ready for photography;
  • Occupants, tenants, pets, and personal belongings are appropriately prepared;
  • Necessary permissions have been obtained;
  • The photographer has safe and lawful access to the property;
  • The property is reasonably safe for photography;
  • Any requested areas are accessible.

The client understands that photographs represent the property as it appears at the time of photography.

Centerville Shutter & Co. does not guarantee that photographs will result in a property being sold, leased, rented, or otherwise transacted.


14. MLS, Brokerage & Third-Party Use

Real estate clients may receive usage rights appropriate for marketing the property associated with the photography assignment.

Unless otherwise authorized, photographs may not be reused for unrelated properties, businesses, listings, publications, advertisements, or other commercial purposes.

When a property is sold, withdrawn, relisted, transferred to another brokerage, or otherwise changes status, continued use of the photographs may be subject to the applicable license.

Third parties—including agents, brokerages, builders, contractors, designers, stagers, publications, and property owners—should obtain appropriate permission or licensing before using photographs outside the original intended purpose.


15. Drone & Aerial Photography

Drone photography and video are subject to weather, airspace restrictions, safety requirements, local restrictions, FAA requirements, and other operational limitations.

A requested drone flight may be delayed, modified, or cancelled when safe or lawful operation is not possible.

Centerville Shutter & Co. does not guarantee that a requested aerial photograph or flight path can be completed.

If required, additional authorization, permits, coordination, or travel may affect pricing and scheduling.


16. Construction & Commercial Photography

For construction, architectural, commercial, and business photography, the client is responsible for providing reasonable access and identifying areas that may be photographed.

The client should notify Centerville Shutter & Co. of:

  • Restricted areas
  • Safety requirements
  • Personal protective equipment requirements
  • Confidential information
  • Proprietary materials
  • Areas that may not be photographed
  • Employees or individuals who should not appear in photographs

Unless otherwise agreed, photographs remain copyrighted by Centerville Shutter & Co. and are licensed to the client according to the applicable agreement.


17. Portrait Photography

Portrait clients are responsible for communicating important preferences, limitations, accessibility needs, and other information that may reasonably affect the session.

Clients should arrive prepared and on time.

For group sessions, the person booking the session is responsible for ensuring that appropriate permissions have been obtained from other participants when necessary.

18. Boudoir Photography & Privacy

Boudoir photography is a private and intimate form of portrait photography.

Centerville Shutter & Co. takes client privacy seriously.

Unless the client provides appropriate written authorization, boudoir images will not be publicly displayed, submitted to contests, published on social media, used in advertising, or otherwise used for promotional purposes.

Clients may request that their boudoir photographs remain private.

Images will be handled with reasonable care and stored using commercially reasonable systems and procedures. However, no electronic storage or transmission system can be guaranteed to be completely secure.

Client Comfort & Boundaries

The client controls their own level of participation in a boudoir session.

A client may decline a pose, wardrobe choice, location, or photographic concept at any time.

Centerville Shutter & Co. will not intentionally photograph a client in a manner that the client has clearly declined.

Clients are encouraged to bring a trusted person with them when desired, subject to space, venue, and safety considerations.

A client's decision to bring a trusted person does not transfer responsibility for that person's conduct to Centerville Shutter & Co.

19. Boudoir Image Release

Boudoir images will not be used for portfolio, website, social media, advertising, promotional material, or other public-facing purposes without an appropriate release or written authorization from the client.

A client may choose to authorize:

  • No public use;
  • Anonymous use;
  • Limited portfolio use;
  • Social media use;
  • Advertising use;
  • Full promotional use; or
  • Another specifically agreed use.

Any authorization should be documented separately and clearly.


20. Minors

Clients participating in portrait sessions involving minors are responsible for providing appropriate parental or legal-guardian consent when required.

Centerville Shutter & Co. reserves the right to request proof of age or authorization when reasonably necessary.


21. Model & Property Releases

Where appropriate, Centerville Shutter & Co. may request a model release, property release, or other authorization.

A release may be required before photographs can be used for certain commercial, advertising, promotional, or other purposes.

Obtaining a release does not automatically transfer copyright ownership.


22. Client Cooperation & Property Preparation

The quality of photography can depend heavily upon preparation.

Centerville Shutter & Co. is not responsible for photographing conditions that the client could reasonably have corrected before the session, including:

  • Excessive clutter
  • Unclean spaces
  • Unfinished repairs
  • Blocked areas
  • Poorly maintained landscaping
  • Personal belongings
  • Occupants
  • Pets
  • Vehicles
  • Construction materials
  • Unsafe conditions

For real estate and commercial assignments, clients should follow any preparation instructions provided before the appointment.


23. Image Delivery & Storage

Finished images will generally be delivered electronically unless another delivery method is agreed upon.

Clients are responsible for downloading and safely storing delivered files.

Centerville Shutter & Co. may maintain backup copies for a limited period but does not guarantee permanent storage of delivered photographs.

Clients should maintain their own backup copies.

If archived files remain available, recovery or re-delivery may be subject to an additional fee.


24. Lost or Damaged Files

Centerville Shutter & Co. takes reasonable precautions to protect photographic files.

However, in the event of catastrophic equipment failure, data corruption, storage failure, theft, accidental deletion, or another event beyond reasonable control, some or all images may become unavailable.

Where reasonably possible, Centerville Shutter & Co. will attempt to recover affected files.

If images cannot be recovered, the photographer's liability will be limited to the remedies stated in the applicable service agreement and applicable law.


25. Client Privacy

When you contact or book with Centerville Shutter & Co., we may collect information necessary to provide services, communicate with you, process payments, schedule appointments, deliver photographs, and maintain business records.

This information may include:

  • Name
  • Email address
  • Telephone number
  • Billing information
  • Property information
  • Session details
  • Photographs
  • Communications
  • Information voluntarily submitted through forms

We do not intentionally collect more personal information than reasonably necessary for business purposes.

Information may be processed or stored through third-party services used to operate the business, such as booking, payment, gallery, website, cloud-storage, communication, or marketing providers.

Third-party services maintain their own privacy policies and terms.


26. Website Cookies & Third-Party Services

This website may use cookies, analytics, security services, embedded content, booking systems, contact forms, social-media integrations, or other third-party technologies.

These technologies may collect information about website usage or interactions.

For example, Google's reCAPTCHA service may be used to protect forms from spam and abuse. Third-party services are governed by their own privacy policies and terms.

By using the website, you acknowledge that third-party services may process information according to their applicable policies.


27. Marketing Communications

If you voluntarily provide your contact information, Centerville Shutter & Co. may use it to communicate regarding an inquiry, booking, project, invoice, gallery, or other business matter.

Marketing communications will be handled in accordance with applicable law.

You may request to stop receiving non-essential marketing communications.


28. Testimonials & Reviews

If a client voluntarily provides a testimonial or review, Centerville Shutter & Co. may display that testimonial for legitimate business and promotional purposes, subject to any applicable restrictions or permissions.

We will not intentionally misrepresent a client's statement or imply an endorsement that was not provided.


29. Photographer Portfolio & Promotional Use

Except where a client has specifically restricted such use in writing, Centerville Shutter & Co. may seek permission to use photographs created during an assignment for portfolio, website, social media, advertising, awards, samples, educational material, or other promotional purposes.

For boudoir and other privacy-sensitive sessions, promotional use will require appropriate authorization.

Commercial, corporate, real estate, or commissioned work may have different promotional-use restrictions based upon the applicable license or agreement.


30. Artificial Intelligence & Image Manipulation

Centerville Shutter & Co. may use software that incorporates artificial intelligence or machine-learning technology as part of ordinary photographic editing, enhancement, organization, noise reduction, masking, retouching, or other post-production processes.

AI-assisted editing does not transfer copyright ownership to the client or create permission for third-party use.

Centerville Shutter & Co. will not intentionally use a client's photographs to create unrelated generative-AI content for public distribution without appropriate authorization.

Specific AI-related requests may be governed by the applicable service agreement.


31. Accessibility

Centerville Shutter & Co. strives to make its website and services accessible and usable by as many people as reasonably possible.

If you experience difficulty accessing any portion of our website or need an accommodation related to a photography service, please contact us.

We will make reasonable efforts to identify an appropriate solution.


32. Limitation of Liability

To the maximum extent permitted by applicable law, Centerville Shutter & Co. will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of our website or photography services.

Except where prohibited by law or otherwise stated in a written agreement, Centerville Shutter & Co.'s liability arising from a photography assignment will generally be limited to the amount actually paid by the client for the affected service.

This limitation does not apply to liability that cannot legally be limited or excluded.


33. Indemnification

To the extent permitted by law, a client may be responsible for losses, claims, damages, or expenses arising from the client's intentional misconduct, violation of a written agreement, unauthorized use of photographs, or failure to obtain permissions that the client was responsible for obtaining.

Nothing in this section requires a client to indemnify Centerville Shutter & Co. for the company's own unlawful conduct.


34. Disputes

Centerville Shutter & Co. prefers to resolve disagreements directly and professionally.

If a dispute arises, the parties should first attempt to resolve the matter through good-faith communication.

Where appropriate, the parties may agree to mediation or another alternative dispute-resolution process.

Any mandatory dispute-resolution procedure, venue, governing law, arbitration provision, or limitation period should be contained in the applicable signed service agreement and reviewed for compliance with Washington law.


35. Governing Law

Unless otherwise required by law or stated in a signed agreement, these general policies are intended to be governed by the laws of the State of Washington.

Nothing in these policies is intended to deprive a consumer of rights that cannot legally be waived.


36. Changes to These Policies

Centerville Shutter & Co. may update these policies periodically.

The current version will be posted on this website with the applicable “Last Updated” date.

Changes to these website policies do not automatically modify the terms of a previously signed service agreement unless the parties agree otherwise in writing or applicable law requires otherwise.


37. No Legal Advice

The information on this page is provided for general business and informational purposes.

It is not legal advice and does not create an attorney-client relationship.

Because laws and regulations can change and because individual circumstances differ, clients with legal questions should consult their own attorney.

Centerville Shutter & Co. recommends that its business agreements and policies be periodically reviewed by qualified legal counsel.
